Terms and Conditions

Who you are contracting with:

  • www.secondhand.wizebooks.co.za  is owned and operated by Wize Books Bulk (Pty) Ltd, registration number: 2014/175187/07 (hereinafter referred to as "Secondhand.WizeBooks").

  • Visitors to the Website ("Users" or "you"), including those Users who purchase any products on the Website ("Purchasers") are bound by these terms and conditions ("T&C"). If you do not agree to these T&C, do not continue to use the Website. Your continued use of the Website will constitute acceptance of the T&C, unmodified by you.

 

Use of Secondhand.WizeBooks

By listing your textbook for sale through the website, you are confirming to us that:

  • you are an individual consumer who is legally capable of entering into binding contracts;

  • you are the legal owner or have the permission of the legal owner to sell textbooks;

  • you are at least 18 years of age or, if you are under 18 years of age, you have obtained your parent%u2019s or guardian%u2019s consent to sell your textbooks for the price indicated on the Website;

  • you are based in South Africa; and

  • you are accessing the Website from South Africa.

  • you have read and understood our return, refund and payout policies.  

 

By listing your book on our website, you confirm that the textbooks you are selling have not been copied and that you have not made any illegal reproductions. Additionally, you agree to indemnify Secondhand.WizeBooks against any potential legal actions related to the sale of your textbooks, including but not limited to copyright or intellectual property issues. Each individual is allowed only one account. If you are found to have multiple accounts, we reserve the right to terminate all accounts and listings immediately. We may also charge a reasonable administration fee to cover any incurred costs, along with any courier fees.

 

If you are found to be abusing or manipulating our website or services, we reserve the right to recover our losses from any payments due for sold textbooks. We may also terminate your accounts and cancel any outstanding amounts owed. Only textbooks are to be sold on this website, you will not be able to list any study guides or workbooks, items of clothing, DVD%u2019s electronics etc. on Secondhand.WizeBooks.

 

Privacy Statement

We respect your privacy and will not disclose your personal information to third parties for marketing purposes, if you have requested us not to do so (which you are able to do at any time via email at info@wizebooks.co.za). The manner in which we use your information is regulated in more detail as described in our Privacy Policy ("Privacy Policy"). The Privacy Policy is hereby incorporated by reference into these T&C. So, if you are not satisfied with the level of privacy we provide or otherwise disagree with anything in the Privacy Policy, then you are deemed to not agree to these T&C and you should not use the Website, because as stated above, your continued use of the Website will constitute acceptance of the T&C, including the Privacy Policy.

 

Sales Records

A full record of every sale and related transaction between you and Secondhand.WizeBooks shall be maintained on the Website for a period of 12 months following the date of such sale or related transaction. You shall thus only be able to view and print such record during this period, whereafter, you shall be responsible for retaining your own record of the relevant sale or related transaction.

 

Secondhand.WizeBooks Products and Availability

Stock availability: Stocks of all goods on offer are based on the books listed by clients. However, should Secondhand.WizeBooks be unable to fulfil any order placed by you at the advertised price due to stock having sold out, Secondhand.WizeBooks will notify you and you will be entitled to a refund of the amount paid by you for such product, as explained in more detail in the Refund Policy ("Refund Policy").

 

Agreements of Sale

Placing a product in a shopping basket or adding it to a wish list without completing the purchase cycle does not constitute an agreement of sale and/or an order for such product, and as such, Secondhand.WizeBooks may remove such product from the shopping basket or wish list if stock becomes unavailable and you cannot hold Secondhand.WizeBooks liable if such product is not available when the purchase cycle is completed at a later stage. An agreement of sale only comes into effect if and when: (a) you electronically submit a properly completed order for one or more products in your shopping basket; and (b) payment is either authorised, or received by Secondhand.WizeBooks in its bank account.

 

The Contract

By clicking %u2018Sell My Books,%u2019 you are making an offer to sell your textbooks to other students at the price indicated by the system. All sales are subject to final acceptance by the buyer. We will confirm the conditional sale to you via email (the "Congratulations" email) once your textbook has been sold. Your items should be collected within 2-5 days of receiving this email, unless a different arrangement is mutually agreed upon. If this timeframe passes, your offer may be cancelled, and you will need to relist your textbooks.

 

Offers

For all textbooks listed on the website, the displayed price constitutes the final selling price.

The prices provided are calculated based on the retail prices of new books, associated courier costs, and the commission fees charged by the site. It is important to use the website's pricing exclusively for textbooks that you own and intend to sell to other users.

 

Termination of Sales and Cancellation of Orders

If you inform us that you no longer wish to sell a book/s, we will remove the relevant textbook/s from our system so that we know you will not be sending your textbook/s.  In those circumstances, you will not be entitled to any payment from us whatsoever seeing as no books were sold.

  • Secondhand.WizeBooks reserves the right, for purposes of preventing suspected fraud to refuse to accept or process payment on any order, and/or to cancel any sale concluded between you and Secondhand.WizeBooks in whole or in part for any reason whatsoever, on notice to you. Secondhand.WizeBooks shall only be liable to refund money already paid by you to us (see Secondhand.WizeBooks%u2019s Refund Policy in this regard), and accepts no other liability which may arise as a result of such refusal to process any order/sale.

    • You are entitled to request a cancellation of any purchase within 7 days of receipt of the goods. Please refer to our Refund policy for more information in this regard.

Value Added Tax: Value added tax at the rate of 15% is charged on goods bought by South African residents.

Errors: Secondhand.WizeBooks shall take all reasonable efforts to accurately indicate prices and delivery charges. However, should products be erroneously offered at incorrect prices and/or delivery charges, Secondhand.WizeBooks shall not be obliged to sell products at such incorrect prices and/or delivery charges, but shall refund money paid by you should you not wish to proceed with the purchase at the correct price and/or delivery charge.

  1. A banking fee of up to 2% shall apply if payment is made through Credit Card, Instant EFT, or MobiCred.

    1. Refunds can only be paid into South African bank accounts.

 

Cancellation by Us

We reserve the right to cancel or amend the contract between us if:

  • the items you send do not meet the condition you specified; or

  • one or more of the items you traded was listed at an incorrect price due to a typographical error or an error in the pricing information stated by us; or

  • the items received are not the same as the items specified at the time of the initial sale.

 

If we cancel your contract, we will notify you via email. If the cancellation is due to our error, we will return the items to you at no cost. However, if the cancellation results from receiving additional items or items that do not meet our Item Condition Guidelines or Quality Checks, we will inform you by email and give you 5 working days to arrange for their collection or pay for their return. If we do not hear from you within that timeframe, we will responsibly recycle the items that fail to meet our guidelines, and you will not receive payment for them.

 

Responsibility and Title

Ownership of the textbook transfers to the buyer as soon as it has been delivered to their address by the designated courier.

 

Restrictions

The Delivery Services are exclusively for textbooks that you are selling through [Website name]. You may not use these services for any other items or purposes. We and our delivery partners accept no liability for any losses or damages resulting from the transportation of any restricted items provided by you. If you (knowingly or unknowingly) attempt to have us or our carriers transport or handle such items, neither we nor our carriers will be liable for any issues arising from those items.

 

Problems with Packages

It is your responsibility to obtain a receipt from the carrier and keep it for tracking purposes. If you are unable to provide a valid receipt for the package you wish to claim, we may not be able to process any claims for loss or damage. You must ensure that the correct items are sent to the buyer. If we receive items other than what was expected, the incorrect book will need to be collected from the buyer and no payout will be made to the seller.  

 

Quality Assessment

Our decision is final where items fail our Quality Assessment. Please note that we are unable to supply photos of rejected items. 

 

Liability

Both parties will only be liable under this contract for losses that are directly attributable to a breach of contract, and such liability will not exceed the maximum transaction value for either party. We will not be liable for any special, indirect, punitive, incidental, or consequential damages related to your contract with us, including but not limited to direct and indirect loss of profit or income, whether arising from contract, tort (including negligence), pre-contract representations (other than fraudulent or negligent misrepresentations), or otherwise.

 

While we will make reasonable efforts to verify the accuracy of information on our website, we make no warranties%u2014express or implied%u2014regarding its accuracy. The website is provided on an %u201Cas is%u201D and %u201Cas available%u201D basis, without any representation or endorsement. We do not guarantee that the website will meet your requirements or be uninterrupted, timely, or error-free. We also do not warrant that any defects will be corrected or that the site or server hosting it is free of viruses or bugs, or that it offers complete functionality, accuracy, or reliability. We will not be liable for any loss of content or materials uploaded or transmitted through the website. You must comply with all applicable regulations and legislation, including obtaining any necessary customs, import, or other permits to trade goods on our site. The importation or exportation of certain goods may be restricted by national laws. We make no representations and accept no liability concerning the export or import of goods you trade.

 

Notwithstanding the above, nothing in these terms is intended to limit any rights you may have as a consumer under applicable local law or other statutory rights that cannot be excluded. We also do not limit our liability for any death or personal injury resulting from our negligence. The site may contain links to other websites. We are not responsible for the content, accuracy, or opinions expressed on those sites, which we do not investigate or monitor for accuracy or completeness. The inclusion of any linked website does not imply our approval or endorsement. If you choose to leave our site and access these third-party sites, you do so at your own risk.

 

Deliveries

Delivery Periods:

  • Delivery periods are only regarded as having commenced upon payment confirmation being received by Secondhand.WizeBooks. If paying with a specific credit card for the first time on the Website, or if Secondhand.WizeBooks regards the transaction to be large and/or unusual, Secondhand.WizeBooks may carry out certain fraud checks with the cardholder%u2019s bank and the delivery period shall only be regarded as having commenced upon completion of such checks.

    • Delivery periods are calculated based on business days only. Saturdays, Sundays and public holidays are not taken into account in calculating delivery periods. So, for eg, if you order something over the weekend, the delivery period will only start running on the next business day, subject to payment and confirmation and fraud checks.

    • If products with different Lead-times are ordered together, the product with the longest delivery time will determine the delivery time of all the products in the order, unless you chose the option of multiple deliveries. So, if you want to order various products where some have a shorter delivery period than others (including so-called %u201924-hour dispatch products%u2019), Secondhand.WizeBooks recommend that you order such products separately from the products requiring longer delivery times as our webstore only allows for 2 x deliveries when you chose multiple deliveries.

    • Secondhand.WizeBooks makes every effort to ensure that the information supplied on the Website is accurate. Where delays and out-of-stock situations occur, every reasonable effort will be made to inform the Purchaser.

All Secondhand.WizeBooks items listed on the Website have an indication of the Lead-time till being dispatched. 

 

Incomplete Order, Damaged or Misprinted Books

If you have received an order that is missing an item, and you have checked that this item is indeed on your invoice you need to report it on the day the order was delivered. If any missing items are reported more than 2 days after an order has been delivered, we do not take the responsibility to send out a replacement for the missing item. If you have received a damaged book, meaning you disagree with the category the book was listed in, Excellent, Good, Fair, it needs to be reported within 48 hours from you receiving it. If the damages are not reported within this time frame, we will not be able to process, exchange or refund it.

 

Secondhand.WizeBooks may not be held liable for any misprinted/misbounded textbooks when being purchased through the website, since this book will never be in the possession of the company and we will not be able to check books. In this case, the purchaser may inform us of the misprinted/misbounded book they have received via e-mail to info@wizebooks.co.za and the seller will be held liable. Secondhand.WizeBooks will deduct the collection fee of the misprinted/misbounded book from the seller and in extreme cases, withhold the entire payout to the seller of the book. To report damages or missing items we require you to send us pictures of the damages or report the missing item via email to info@wizebooks.co.za with your order number as the subject line of the email.

 

REFUND POLICY

There will be NO refunds, Returns or cancellations for the sale of 2nd hand books. Refunds can only be paid into South African bank accounts.

 

If you have received a textbook in a WORSE condition compared to when you reviewed it, you can send us an email WITHIN 24 HOURS of delivery to info@wizebooks.co.za WITH PHOTOS and the subject %u201CCondition of book NOT correct: Order number: XXXX (Where XXXX is replaced by your order number). If you have not received a response from us within 2 (two) business days, please give us a call on 012 362 5885 to confirm whether it has been received. 

 

Secondhand.WizeBooks will review the photos and assess whether the condition is worse. If Wize Books concludes the condition is indeed lower than what you selected, you will be refunded for the difference is the condition you paid for and the condition you received. 

 

For example: Excellent condition book costs R300 and the Good condition costs R250. You paid for an Excellentcondition book and Wize Books concludes that you did indeed receive a Good condition then you will receive a R50 refund (R300-R250).

 

Payment Methods

Subject to any exceptions expressly mentioned below, your payment for any products ordered from Secondhand.WizeBooks must be made to us in any one of the following ways:

  1. Credit card payments:

At the time of placing the order, the transaction details are presented to the bank and payment is collected immediately. If the bank%u2019s authorisation is not obtained, the order will be cancelled. Secondhand.WizeBooks may carry out certain fraud checks with the cardholder or the cardholder%u2019s bank, should Secondhand.WizeBooks be unable to verify the validity of the transaction the order will be cancelled.

 

Storing credit card details: Note that the Website may enable you to store your credit card details for easy usage later. However, Secondhand.WizeBooks is not the one collecting, storing or otherwise processing your credit card details. Instead, it is PayU Payment Solutions (Pty) Ltd ("PayU"), a Payment Card Industry ("PCI") compliant payment service provider, who will collect, store and process your credit card details for you, and display them to you later on the payment page of the Website and/or other external websites which support this PayU facility. More specifically, by selecting to have your credit card details stored, you will be doing the following:

  • Contracting with PayU who will collect, store and process your credit card details for you on its systems in an encrypted format in PayU%u2019s secure PCI-compliant environment (which is why you will be clicking to agree to its standard terms of service that are applicable to you);

    • Agreeing that Secondhand.WizeBooks may disclose (by means of a link between the Website and the systems of PayU) to PayU such of your information that Secondhand.WizeBooks has on record as is necessary to enable PayUi) to verify your identity and determine whether you are already a registered PayU user or not; ii) to create a profile for you and store your credit card details with reference to that profile; and iii) to check against your profile and pre-populate your credit card details on the Website, whenever you log into your account (without you having to actively call upon PayU to do so each time).

2. Bank deposits & Electronic Funds Transfer:

If you select to pay via this method, instructions will be given on how to deposit money into Secondhand.WizeBooks%u2019s bank account and it would be subject to the following rules:

  • the exact amount must be paid;

    • the payment must be identified by supplying the order number and surname in the reference section of the deposit slip or on the electronic transfer;

    • no transfers may be made from ATM%u2019s;

    • cheque deposits are subject to a clearing period.;

    • no bank deposits are accepted from outside the borders of South Africa; and

    • your order will be cancelled if you choose to pay by bank deposit and the amount due is not paid within 5 business days.

    • Your payment will only be allocated as received once cleared on our Bank Statement. Please note orders are only finalised once money is received and other customers might end up securing the same book before your money reflects %u2013 in this case you will have to wait until a new copy becomes available or you can request a refund. 

3. Mobicred:

  • Mobicred is a credit facility that allows you to pay for your books/orders in monthly installments. You can apply for a Mobicred account and find out more about their process at: https://mobicred.co.za/ 

4. Ozow:

Ozow offers you an instant EFT payment option, therefore Cutting out the delays experienced with traditional EFT's.

 

Changes to Legal Notices

We reserve the right to change these terms and conditions from time to time and you should look through them each time you use the site. Secondhand.WizeBooks may, in its sole discretion, change these T&C or any part thereof at any time on notice to you. It is your responsibility to ensure that you are satisfied with the amendments. Should you not be satisfied with the amendments, you must refrain from placing any further orders on, or from using in any way, the Website.

 

Disputes

Between you and Secondhand.WizeBooks: Save for urgent or interim relief which may be granted by a competent court, in the event of any dispute of any nature whatsoever arising between you and Secondhand.WizeBooks on any matter provided for in, or arising out of these T&C, and not resolved through the Customer Services Department of Secondhand.WizeBooks, then such a dispute shall be submitted to confidential arbitration in terms of the expedited rules of the Arbitration Foundation of South Africa. The expedited arbitration rules may be downloaded from http://www.arbitration.co.za/downloads/expedited_rules.pdf.

 

Law, Jurisdiction and Language

This Website is hosted, controlled and operated from the Republic of South Africa and therefore governed by South African law and, subject to the %u2018Disputes%u2019 clause of these T&C, you and Secondhand.WizeBooks submit to the non-exclusive jurisdiction of the South African courts.

 

Restrictions on Sales

Age restrictions:

The onus is on you to ensure that you and/or the person for whom you may be buying a product on the Website, meet any age restrictions applicable to such product and that these restrictions are observed. For example, if you make a website purchase of a book for a friend, the onus is on you to ensure that the book is suitable for such child%u2019s age or that your friend is at least 18 years old (as the case may be). Accordingly, you indemnify Secondhand.WizeBooks from all liability in this regard, including any liability arising as a result of your failure to provide accurate information in this regard when completing the Website registration process.

 

Third Party Rights

Nothing in this Agreement is intended to, nor shall it confer any rights on a third party.

 

Disclaimer

Save for Secondhand.WizeBooks being liable to you %u2013

  • Under the Consumer Protection Act 68 of 2008 ("CPA") in relation to any products sold by Secondhand.WizeBooks to you via the Website; and

    • Under sections 43(5) and 43(6) of the ECT Act in relation to Secondhand.WizeBooks payment systems not being sufficiently secure, neither Secondhand.WizeBooks nor any of its agents or representatives shall be liable for any damage, loss or liability of whatsoever nature arising from the use or inability to use this Website or the services or content provided from and through this Website. Furthermore, Secondhand.WizeBooks makes no representations or warranties, implied or otherwise, that, amongst others, the content and technology available from this Website and associated communications are free from errors or omissions or that the service will be 100% uninterrupted and error-free. You are encouraged to report any possible malfunctions and errors to info@wizebooks.co.za

    • Although the products sold via the Website may be under warranty, the Website itself is supplied on an "as is" basis and has not been compiled or supplied to meet your individual requirements. It is your sole responsibility to satisfy yourself prior to accepting these T&C that the service and products available from and through this Website will meet your individual requirements.

Security

Any person that delivers or attempts to deliver any damaging code to this Website or attempts to gain unauthorised access to any page on this Website shall be prosecuted and civil damages shall be claimed in the event that Secondhand.WizeBooks suffers any damage or loss. You agree and warrant that your log-in name and password shall be used for your personal use only and shall not be disclosed to any third party. You allow Secondhand.WizeBooks to take all reasonable steps to ensure the integrity and security of the Website and back-office applications. All credit card transactions are Secure Socket Layers encrypted. Secondhand.WizeBooks registration documents and the Website%u2019s registered domain name are checked and verified by Thawte.

Secondhand.WizeBooks chooses as its address for all purposes under these T&C, whether in respect of court process, notice, or other documents or communication of whatsoever nature, the following address: Po Box 2829, Faerie Glen, 0043 with a copy to cdhechter@wizebooks.co.za (the sending of such copy being required in order for any notice to be validly delivered to Secondhand.WizeBooks).

 

Term and Termination

These T&C shall commence from the date on which they are published on the Website and continue indefinitely, as amended by Secondhand.WizeBooks from time to time (as described above), for so long as the Website exists and is operational, Secondhand.WizeBooks being entitled to terminate these T&C and/or shut down the Website at any time (subject to still processing any orders then already placed and accepted by Secondhand.WizeBooks).

 

Copyright & other Intellectual Property Rights

Any and all copyrighting of this Website, including our T%u2019s & C%u2019s, vests in Secondhand.WizeBooks. Accordingly, and all rights not expressly granted are reserved and should be requested from info@wizebooks.co.za. You may however read, print or even download them from our website for private or non-commercial purposes.

 

Secondhand.WizeBooks and its management cannot review or edit all the information and or content on the Website and accordingly, we do not accept any liability for illegal, defamatory or obscene content.
